NATIONAL PUMP & ENERGY – ESKY TRADESHOW GIVEAWAY

TERMS AND CONDITIONS

1.     Definitions

In these Terms and Conditions (“Terms”) the following words and phrases have the meaning listed:

  • “Entrant” means the participant who has submitted a completed entry form for this Draw.
  • “Draw” means the free-entry trade promotion lottery in which the Entrant obtains a random chance to win the Prize.
  • “Prize” means YETI 35L Esky with a registered retail price of $400.
  • “Promoter” means National Pump & Energy Pty Ltd ABN 83 098 812 492 (“NPE”) of 332 Treasure Road, Welshpool WA 6106, and its subsidiaries and related entities.
  • “Purpose” means promotion of the business carried on by NPE.

2.     The Draw

  1. Entry into the Draw is free of charge. No purchase is necessary.
  2. Entry is open to all Australian residents aged 18 years or over, excluding the Promoter’s current directors, management and employees and their immediate family members. Immediate family includes but is not limited to a spouse, child, parent or sibling.
  3. By completing an entry form and participating in the Draw, the Entrant confirms they are eligible to enter and agrees to be bound by these Terms.
  4. Entries may be submitted in person at the Promoter’s stand at the TACTIC 2026 Conference & Trade Expo, Central Oval Complex, 10 Augusta Terrace, Port Augusta SA 5700, from 12:00pm ACST on Tuesday 28 July 2026 until 5pm ACST on Wednesday 29 July 2026.
  5. Only one entry is allowed per person.
  6. The winner will be drawn at random at the Promoter’s stand, Central Oval Complex, 10 Augusta Terrace, Port Augusta SA 5700 at 2pm ACST on Wednesday 29 July 2026.
  7. The winner will be notified at the draw if present and, in any event, by telephone and/or email using the contact details provided on the entry form.
  8. The Promoter will publish the initial of the winner’s first name, the winner’s last name and the winner’s postcode on the Promoter’s website (www.nationalpump.com.au) within thirty (30) days of the draw.
  9. If the winner is present at the draw, the Prize may be collected immediately. If the winner is not present, the Promoter will make reasonable attempts to contact the winner using the details provided, and the Prize must be claimed within three (3) months of the date of the draw.
  10. If the Prize remains unclaimed at the end of that period, the Promoter will conduct an unclaimed prize draw at the Promoter’s office at 1381 Main North Road, Para Hills West SA 5096 at 10:00am ACST on the fifth (5th) business day after the end of the claim period. The Promoter will notify and publish the result of that draw in the same manner as the original draw, including publication of the initial of the winner’s first name, the winner’s last name and the winner’s postcode within thirty (30) days.
  11. The Prize is non-transferable, non-refundable and non-redeemable for cash, substitute prizes or goods and services.
  12. If the Prize becomes unavailable due to circumstances beyond the Promoter’s control, the Promoter may, in its absolute discretion and to the extent permitted by law, substitute a prize of equal or greater value.

3.     Liability

  1. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on the Entrant by the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) or any other law that cannot lawfully be excluded, restricted or modified.
  2. Subject to clause 3(a) and to the extent permitted by law, the Promoter is not liable for any costs associated with the Entrant’s entry into the Draw or any costs associated with the Prize, including any costs associated with use, fault, defect or warranty.
  3. Subject to clause 3(a) and to the extent permitted by law, all Entrants release and indemnify the Promoter against all liability, cost, expense, loss or damage arising out of participation in the Draw and/or acceptance of the Prize (including consequential loss or damage, which is not limited to loss of income, personal injury, damage to property, and whether direct or indirect, foreseeable or unforeseeable, or due to negligence).
  4. The Promoter reserves the right to disqualify an Entrant whom the Promoter reasonably believes has breached these Terms or engaged in improper or unlawful conduct.
  5. The Promoter’s decision on all matters relating to this Draw is final and not subject to negotiation or correspondence.

4.     Consent and Publicity

  1. The Entrant acknowledges that the Promoter has the right to publicise and publish the winner of the Draw, including as required by South Australian lottery requirements.
  2. If the Entrant accepts the Prize, the Entrant agrees to reasonable participation in publicity surrounding the Draw, including publication of their name on the Promoter’s website, social media and other marketing materials. Publication of the Entrant’s photo will occur only where the Entrant has given separate written consent on the entry form.
  3. Entry to the Draw is not conditional on agreeing to receive marketing. The Entrant may, enter via raffle book page or completing online form via QR code, choose to subscribe to the Promoter’s marketing database. The Entrant may unsubscribe at any time by emailing marketing@nationalpump.com.au.
  4. The Entrant acknowledges that the Promoter will retain entry records for the period required under the Lotteries Act 2019 (SA) and the Lotteries Regulations 2021 (SA), and applicable South Australian trade promotion lottery requirements, and otherwise in accordance with the Promoter’s Privacy Policy.

5.     Privacy

  1. The Promoter may use the Entrant’s details for the purpose of conducting the Draw, communicating with the Entrant, providing goods and services, and (where the Entrant has opted in) marketing the Promoter’s business.
  2. The Entrant’s personal information is collected, used, stored and disclosed in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles and the Promoter’s Privacy Policy available at https://www.nationalpump.com.au/privacy-policy/.
  3. If the Entrant does not want their details used for marketing, they may email marketing@nationalpump.com.au.

6.     Miscellaneous

  1. The Draw and these Terms are governed by the laws of South Australia, and any disputes are subject to the exclusive jurisdiction of the courts of South Australia.
  2. Subject to clause 3(a), and to the extent permitted by law, the Promoter excludes all implied terms (including any implied warranties and any terms implied by statute, common law or otherwise) relating in any way to this Draw.
  3. These Terms constitute the entire agreement of the parties and supersede all prior representations, understandings, undertakings or agreements (whether oral or written, express or implied) of the parties.
